Terms of Service for Athesus Vision

1. Acceptance of Terms

Welcome to Athesus Vision ("the Application", "we", "us", or "our"). By accessing or using Athesus Vision, you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application.

These Terms constitute a legally binding agreement between you and Athesus Vision. Please read them carefully.

2. Description of Service

Athesus Vision is a desktop automation application that provides:

• AI-powered task automation
• Computer control and interaction
• Email integration (Gmail, Outlook, SMTP)
• File management and operations
• Web browsing automation
• And other productivity features

The Application is provided as a software-as-a-service (SaaS) with both free and paid subscription tiers.

3. Account Registration and Security

3.1 Account Creation

• You must create an account to use certain features of the Application
• You must provide accurate and complete information during registration
• You must be at least 13 years of age to create an account
• You are responsible for maintaining the confidentiality of your account credentials

3.2 Account Security

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage arising from unauthorized account access
• You must not share your account credentials with others

3.3 Account Termination

• You may terminate your account at any time through the Application settings
• We reserve the right to suspend or terminate accounts that violate these Terms

4. Subscription and Payment

4.1 Subscription Tiers

• Free Tier: Limited to 8,000 tokens per month
• Pro Tier: Unlimited tokens at £9.99/month (or equivalent in your currency)

4.2 Payment Terms

• Subscriptions are billed monthly via GoCardless
• Payments are processed automatically on your billing cycle date
• All fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days' notice

4.3 Token Usage

• Tokens are consumed when using AI-powered features
• Free tier tokens reset monthly on your billing cycle date
• Unused tokens do not roll over to the next month
• Pro tier users have unlimited token usage

4.4 Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of your current billing period
• No refunds are provided for partial months
• You retain access to Pro features until the end of your paid period

5. Acceptable Use Policy

You agree NOT to use Athesus Vision to:

5.1 Prohibited Activities

• Violate any local, state, national, or international law
• Infringe on intellectual property rights of others
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to other systems
• Harass, abuse, or harm others
• Send spam or unsolicited commercial emails
• Impersonate any person or entity
• Interfere with or disrupt the Application or servers

5.2 Automation Restrictions

• You must not use the Application to automate activities that violate third-party terms of service
• You are responsible for ensuring your automated tasks comply with all applicable laws
• You must not use the Application for fraudulent or deceptive purposes
• You must not automate tasks that could harm others or their systems

5.3 Email Usage

• You must not use email features to send spam or unsolicited messages
• You must comply with CAN-SPAM Act and similar anti-spam laws
• You must not impersonate others when sending emails
• You are responsible for the content of emails sent through the Application

6. Intellectual Property Rights

6.1 Our Rights

• Athesus Vision and all related trademarks, logos, and content are owned by us
• The Application's source code, design, and functionality are protected by copyright
• You may not copy, modify, distribute, or reverse engineer the Application
• All rights not expressly granted to you are reserved by us

6.2 Your Rights

• You retain all rights to content you create using the Application
• You grant us a limited license to process your data as necessary to provide the service
• You are responsible for ensuring you have rights to any content you process through the Application

6.3 Feedback

• Any feedback, suggestions, or ideas you provide to us become our property
• We may use your feedback without compensation or attribution
• You waive any rights to feedback you provide

7. Third-Party Services and Integrations

7.1 Third-Party Terms

• The Application integrates with third-party services (Google, OpenAI, etc.)
• Your use of these integrations is subject to their respective terms of service
• We are not responsible for third-party service availability or performance
• You must comply with all third-party terms when using integrations

7.2 Gmail Integration

• Gmail access is subject to Google's Terms of Service and API policies
• You can revoke Gmail access at any time via your Google Account
• We use Gmail data only as described in our Privacy Policy
• Google may suspend or terminate Gmail API access at their discretion

7.3 AI Services

• AI features use third-party language models (OpenAI, OpenRouter, Ollama)
• AI-generated content may be inaccurate or inappropriate
• You are responsible for reviewing and verifying AI-generated content
• We do not guarantee the accuracy or quality of AI outputs

8. Disclaimers and Limitations of Liability

8.2 No Warranties

• You are responsible for supervising automated tasks
• We are not liable for unintended actions performed by the Application
• You should test automation tasks before running them on important data

9. Indemnification

You agree to indemnify, defend, and hold harmless Athesus Vision, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
